Hearing on the writ petitions filed against the decision of the government to dissolve the House of Representatives continued before the constitutional bench of the Supreme Court today. Six advocates presented their arguments on behalf of the petitioners today.
To allow more advocates to take part in the hearing, Chief Justice Cholendra Shumsher JB Rana, who is chairing the bench, designated 30 minutes each for the advocates to complete their arguments. At the end of the fourth day today, 18 legal practitioners have pleaded before the bench.
Taking part in the hearing today, senior advocate Dr Chandra Kant Gyawali said the constitution does not have a provision for dissolution of the HoR, and hence the court should interpret the same provision. In the event when the HoR is already dissolved, the matter should be decided based on the constitutional provisions.
Likewise, senior advocate Krishna Prasad Bhandari said the apex court should interpret the Constitution considering the supremacy of the people. Advocate Anita Joshi Manandhar, Jhala BK, Nawaraj Pandey, Govinda Basaula and Sujan Nepal also argued that the decision to dissolve the HoR should be annulled as the house was elected for a five-year term.
One of the writ petitioners, Kanchan Krishna Neupane, said that since the Constitution does not envisage election before five years, the decision to go for fresh elections before that should be repealed.
The hearing will continue on Thursday.
