HoR dissolved through inapplicable Article of Constitution, four former Chief Justices say

Four former Chief Justices have said that the government recommended for the House of Representatives (HoR) dissolution by using the Constitution's Article that is not applicable.

Issuing a press statement on Friday, former Chief Justices Min Bahadur Rayamajhi, Anup Raj Sharma, Kalyan Shrestha and Sushila Karki have argued that the Constitution has not given right for the HoR dissolution.

"There is no provision for the HoR dissolution except for the formation of Council of Ministers in Article 76 of the Constitution of Nepal 2015 and the HoR was dissolved on the basis of Article which is inapplicable," the statement read.

The fundamental norms of constitution and its direction cannot be changed on the basis of any contemporary incident and particular context, the former CJs have argued that they have the firm belief on addressing the situations on the basis of constitution and constitutionalism.
