Kathmandu: The hearing of the writ registered against Prime Minister KP Sharma Oli-led incumbent government will be held in the full bench of the Supreme Court. While citing it a constitutional matter, a divisional bench of Justice duo, Til Prasad Shrestha and Shreekanta Paudel, issued the order to undertake the hearing over the writ that was registered demanding PM Oli-led government be declared ‘caretaker’ following the hearing.
According to National News Agency Nepal, the court has identified a complex constitutional question involving the interpretation of Nepal Constitution’s Article 100 (2) in the writ petition. Consequently, the case has been presented to the full bench in accordance with the Supreme Court Regulation, 2074’s rule 23(2).
The court has also ordered the retrieval of the letter of support provided to political parties during the formation of the incumbent government on 16 July 2024 from the Office of the President. Additionally, it has instructed the collection of details from the parliament secretariat reflecting the vote score based on the political parties that cast a vote of trust to the incumbent government on 21 July 2024.
Further, the court has mandated the production of documents from the offices of different political parties regarding decisions made by Nagarik Unmukti Party, Janata Samajwadi Party (Ashok Rai), and Samajwadi Party (Upendra Yadav) in connection with granting a vote of confidence on 21 July 2024. Advocate Birendra KC had registered the writ at the Supreme Court, demanding that PM Oli be ordered to take a vote of confidence from the House of Representatives within 30 days, in light of the Janata Samajwadi Party and Nagarik Unmukti Party withdrawing their support from the government.
