Judiciary Upholds Rule of Law: CJ Raut

Kathmandu: Chief Justice Prakashman Singh Raut has emphasized that the judiciaries of Nepal and India play a crucial role in protecting human rights, promoting equality, and upholding the rule of law. In his speech at the ‘Nepal-India Judicial Dialogue on Recent Jurisprudence and Justice Sector Reforms, 2025’, organized by the Supreme Court in the federal capital on Friday, he highlighted the shared legal agendas of social equality and climate justice between the two nations.

According to National News Agency Nepal, CJ Raut remarked that Nepal and India share common legal traditions and are collaborating with legal and judicial communities. He noted the ongoing judicial cooperation between the two countries, with successful collaborations in the dimensions of law and the judicial arena. Raut outlined the legal challenges Nepal is currently facing, such as cybercrime, consumer rights protection, climate change, gender justice, and the rights of indigenous and marginalized communities.

The professional collaboration between the two countries in law and judiciary, along with their geographical and cultural ties, has led to improved case management and better use of IT, Raut stated. Chief Justice of India, Bhushan Ramkrishna Gavai, also addressed the event, highlighting the longstanding exchange of best practices between the supreme courts of India and Nepal. He expressed the need for further understanding to foster collaboration that enhances the democratic system and legal reforms in both nations.

Senior Justice at the Supreme Court, Sapana Pradhan Malla, asserted the commitment of Nepal’s judiciary to delivering free and fair justice, thus ensuring equality. She explained that Nepal’s Supreme Court has established property rights for daughters, marriage registration for same-sex persons, and recognition of same-sex marriage as well as the rights of disabled persons. Malla also pointed out the challenges faced by the court, including political interference and media and social network trials.

Indian Chief Justice Gavai arrived in Nepal at the invitation of CJ Raut on Thursday to participate in the event. He is scheduled to visit the Mayadevi Temple in Lumbini before returning to India on Saturday.
