Kathmandu: The Supreme Court (SC) has ordered the release of Durga Prasain, a medical entrepreneur and Coordinator of the Rastra, Rastriyata Bachau Abhiyan. Prasain was detained as part of an investigation into public security concerns but will now be freed following the court’s decision.
According to National News Agency Nepal, Prasain’s release was mandated by the SC following a habeas corpus writ petition filed by his son, Nirajan. The division bench, comprising Justices Nahakul Subedi and Shree Kanta Paudel, ruled in favor of his immediate release. The court emphasized that detaining Prasain solely for his expressions was a breach of his constitutionally protected right to freedom of expression.
The SC also noted that further investigations, detention, or extended procedural actions were unnecessary in light of an agreement between the Rastra, Rastriyata Bachau Abhiyan and the government. The agreement, reached on Saturday, affirms the organization’s commitment to conducting its activities in a peaceful manner. Prasain was initially arrested from his Sanothimi, Bhaktapur residence on November 17, but his continued detention was deemed unwarranted by the court.
